Hearing Set for Today at 2 p.m.

In response to questions and concerns raised by both the Chelan and Douglas Superior Courts, plaintiffs have combined their Chelan and Douglas county lawsuits into one to be heard in front of Judge Kristin Ferrara. This amendment is intended to ensure that only one court ruling affects all the obligations and responsibilities of the Chelan Douglas County Health District.

Additionally, during Thursday’s hearing before Judge Ferrara, the Attorney General repeatedly insisted that the entire case should move to Thurston County because nothing about the Governor’s Proclamation and state lockdown enforcement was happening in Chelan County. But during the hearing, while the Attorney General argued that Chelan was somehow being left alone, state enforcers were visiting local business owners in Chelan County, forcing them to close their business or face crippling fines and lose their state business licenses for life. Those business owners have now joined the lawsuit, asking the court to address the harms the Governor and State are imposing in Chelan County.

In light of the changed pleadings intended to address the questions of the court and claims of the Attorney General, plaintiffs have asked to delay today’s hearing in order to give the Attorney General time to evaluate and reconsider its position. However, thus far, the Attorney General has insisted that nothing has changed and demanded that Judge Ferrara hold the scheduled hearing this afternoon, Monday, June 1 at 2pm. It remains to be seen what the Attorney General will say about the enforcement actions the State undertook during Thursday’s hearing.
